1. About Fate Jewellery
Our contact details are:
Trading name: Fate Jewellery
Business address: Tyneview House, BLAYDON-ON-TYNE NE21 5DH
Email: hello@fatejewellery.co.uk
Website: https://fatejewellery.co.uk
Fate Jewellery is not currently registered for VAT.
These Terms apply when you use our website or purchase jewellery or other products from us. Please read them before placing an order.
Nothing in these Terms affects your statutory consumer rights.
2. About Our Jewellery
Fate Jewellery produces handmade jewellery using Argentium Silver, Sterling Silver, natural gemstones and other materials described in each product listing.
Our jewellery is individually handcrafted. Small differences in texture, shape, pattern, finish and dimensions are part of the handmade process and do not necessarily constitute faults.
Natural gemstones may contain inclusions and variations in colour, pattern, transparency, shape and surface texture. These characteristics are part of the natural stone rather than manufacturing defects.
We make every reasonable effort to display product colours and details accurately. However, colours may appear slightly different depending on lighting, photography and the screen or device being used.
For one-of-a-kind products, you will receive the individual piece shown unless the product description states otherwise. Made-to-order pieces may vary slightly from the example photographs because each one is made individually by hand.
3. Product Information and Availability
We take reasonable care to ensure that product descriptions, prices, measurements and availability are accurate.
Measurements are approximate unless expressly stated otherwise. Please check product dimensions, ring sizes, chain lengths and other details carefully before ordering.
All products are subject to availability. Placing an item in your basket does not reserve it.
Because many pieces are one of a kind and may also be offered through other sales channels, an item may occasionally sell elsewhere before our website stock information has updated. If this happens, we will contact you promptly and provide a full refund.
We may withdraw a product or correct inaccurate product information at any time before accepting an order.
4. Placing an Order
When you place an order, you are offering to purchase the selected products under these Terms.
After ordering, you will receive an order confirmation email. This confirms that we have received your order but does not necessarily mean it has been accepted.
A contract between you and Fate Jewellery is formed when we send confirmation that your order has been accepted or dispatched.
We reserve the right to decline or cancel an order before dispatch where, for example:
-
The product is unavailable.
-
Payment has not been authorised.
-
There is an obvious pricing or product-description error.
-
We cannot deliver to the address supplied.
-
We reasonably suspect fraud, misuse or unlawful activity.
If payment has already been taken for an order we cannot accept, we will issue a full refund.
Please review your order and delivery information carefully before completing payment. Contact us promptly if you notice an error.
5. Prices and Payment
Prices are displayed in the currency selected on the website.
Fate Jewellery is not currently VAT registered, so VAT is not charged separately.
Delivery charges, where applicable, are displayed before you complete checkout.
Payment must be made using one of the payment methods offered at checkout. Payment transactions may be processed by Shopify Payments, PayPal or another secure third-party payment provider.
We do not receive or store your complete payment-card details.
If we discover an obvious pricing error before accepting an order, we will contact you and give you the choice of proceeding at the correct price or cancelling for a full refund.
6. Discount Codes and Promotions
Discount codes and promotional offers are subject to any additional conditions stated with the promotion.
Unless otherwise stated:
-
Only one discount code may be used per order.
-
Discount codes cannot be exchanged for cash.
-
Codes cannot be applied retrospectively.
-
Promotions may be withdrawn or amended before an order is placed.
-
Discount codes may exclude commissions, custom work, gift cards or selected collections.
We will not cancel an accepted order merely because a promotion subsequently ends.
7. Ready-to-Ship and Made-to-Order Times
Ready-to-ship jewellery is normally prepared for dispatch within 1–3 working days.
Made-to-order jewellery will have an estimated making time stated in the product description. Made-to-order rings will usually take approximately 1–2 weeks before dispatch unless otherwise agreed.
Commissioned or particularly complex pieces may take longer. The expected timescale will be agreed with you before work begins.
Making and dispatch times are separate from the delivery time offered by the postal or courier service.
If a significant delay occurs, we will contact you as soon as reasonably possible.
Unless a different timeframe has been agreed, goods will be delivered within 30 days after the contract is made.
8. Delivery
Available delivery methods, charges and estimated times are shown at checkout or on our Delivery Policy page.
UK orders are sent using a tracked delivery service. Any free-delivery offer and its applicable order threshold will be displayed on the website.
Delivery times are estimates rather than guaranteed dates unless we have expressly agreed otherwise.
You are responsible for providing a complete and accurate delivery address. Please contact us immediately if an address needs correcting. We cannot guarantee that an address can be changed after dispatch.
Responsibility for the goods passes to you when they are delivered to you or to a person you have nominated to receive them.
If an order is returned to us because the address supplied was incorrect, incomplete or the parcel was not collected, we may ask you to pay reasonable redelivery costs.
Please contact us if a parcel appears delayed, lost or damaged so that we can investigate with the delivery provider.
9. International Orders
International customers are responsible for ensuring that jewellery ordered from Fate Jewellery can lawfully be imported into their destination country.
Where duties and import taxes are expressly shown as included, no additional amount should be payable on delivery. In all other cases, the customer may be responsible for local customs duties, import taxes, handling charges or similar fees imposed by the destination country.
International customs procedures may cause delays outside our reasonable control.
Customers outside the UK may also have mandatory consumer rights under the laws of their own country. These Terms do not remove rights that cannot lawfully be excluded.
10. Cancelling an Order Before Dispatch
Please email hello@fatejewellery.co.uk as soon as possible if you wish to cancel or amend an order.
Standard orders may normally be cancelled before dispatch for a full refund.
Bespoke, personalised or custom-made work may not be cancellable once materials have been ordered or work has started. We will explain any applicable cancellation conditions before accepting a commission.
Your statutory cancellation rights are explained below.
11. Your Right to Cancel an Online Purchase
For most products purchased online, UK consumers have a legal right to cancel without giving a reason.
Our goodwill returns policy allows you to notify us that you wish to return an eligible item within 30 days of receiving it.
To cancel, email hello@fatejewellery.co.uk with your name, order number and a clear statement that you wish to cancel or return the order. You may also use the model cancellation form at the end of these Terms.
Once you have notified us, please return the item within 14 days.
Items must be securely packaged and returned to:
Fate Design - Tyne View House, Tyne Street, BLAYDON-ON-TYNE, NE21 5DH
We recommend using a tracked and adequately insured postal service. You remain responsible for the returned item until it is received by us.
Unless an item is faulty, damaged, incorrectly supplied or we have agreed otherwise, you are responsible for the direct cost of returning it.
You may examine jewellery as you would reasonably be permitted to do in a shop. We may make a lawful deduction from the refund where handling beyond what is reasonably necessary has reduced the item’s value.
12. Refunds
For an eligible cancellation, we will refund:
-
The price paid for the returned product.
-
The cost of our least expensive standard delivery option, if you paid an initial delivery charge and the whole order is cancelled.
Additional amounts paid for an enhanced or express delivery option are not normally refundable beyond the cost of standard delivery.
We will issue the refund within 14 days after receiving the returned goods or, if earlier, receiving acceptable evidence that they have been sent back.
Refunds will normally be made to the original payment method unless otherwise agreed.
If you return only part of a multi-item order, the original delivery charge may not be refundable where it would have been charged for the retained items in any event.
13. Items That Cannot Normally Be Returned for Change of Mind
The cancellation and goodwill returns policy does not normally apply to:
-
Jewellery made to your individual specifications.
-
Clearly personalised or engraved jewellery.
-
Bespoke commissions.
-
Jewellery permanently altered or resized specifically for you.
-
Earrings or other items supplied in sealed hygiene packaging where the seal has been broken after delivery, where the legal hygiene exemption applies.
-
Gift cards, except where cancellation rights apply by law.
Simply describing an item as “made to order” does not automatically remove cancellation rights. Where a product is genuinely bespoke or personalised and excluded from cancellation, this will be made clear before purchase.
These exclusions do not apply where an item is faulty, damaged, not as described or where another statutory right applies.
14. Ring Sizes and Alterations
Please take reasonable care to confirm the required ring size before ordering. We recommend having your finger measured professionally where possible, particularly for wide-band rings.
A ring made or permanently resized to a customer’s specific measurements may be treated as a customised product.
If a ring does not fit, contact us to discuss whether resizing is possible. Some gemstones, settings and band designs cannot safely be resized.
Resizing, alteration, additional materials and postage may incur a charge unless the ring was supplied in a size different from the one ordered or is otherwise faulty.
Any alteration carried out by another jeweller without our prior agreement may affect our ability to assess or remedy a later problem, although it does not remove statutory rights where those rights still apply.
15. Faulty, Damaged or Incorrect Products
We take care to inspect jewellery before dispatch.
Under the Consumer Rights Act 2015, goods must be as described, of satisfactory quality and fit for their intended purpose.
If your order arrives damaged, faulty or incorrect, please contact hello@fatejewellery.co.uk as soon as possible and include:
-
Your name and order number.
-
A description of the problem.
-
Clear photographs where reasonably possible.
Where goods do not meet the required legal standard, you may be entitled to a refund, repair or replacement depending on the circumstances and the applicable law.
We will pay reasonable return costs where an item is confirmed to be faulty, damaged on arrival or incorrectly supplied.
Fair wear and tear, accidental damage, misuse, failure to follow reasonable care instructions, or damage caused by an unauthorised repair is not normally a product fault.
Nothing in this section limits your statutory rights.
16. Handmade Characteristics and Jewellery Care
Handmade textures, tool marks intentionally forming part of a finish, minor differences between matching handmade pieces and the natural characteristics of gemstones are not normally faults where they are consistent with the product description and photographs.
Jewellery should be handled and stored with reasonable care. Avoid exposure to harsh chemicals, bleach, perfume, chlorine and unnecessary impact.
Gemstones vary in hardness and durability. Some stones require more careful handling than others. Care information supplied with a product should be followed.
Tarnishing, surface scratching and the gradual wearing of polished, brushed or textured finishes may occur naturally through use and are not necessarily manufacturing faults.
17. Commissions and Bespoke Work
Bespoke commissions will be subject to the design, materials, price, deposit, expected timescale and other details agreed with you in writing.
A non-refundable deposit may be requested before design work, gemstone purchasing or making begins. Any deposit conditions will be explained and agreed before payment.
Designs, sketches and gemstone suggestions may be amended during the agreed design stage. Material changes requested after work begins may result in additional charges or a revised completion date.
Because bespoke and personalised jewellery is made specifically for the customer, it is normally excluded from change-of-mind cancellation rights. This does not affect rights relating to faulty or misdescribed goods.
18. Gift Cards
Gift cards are subject to any validity period and conditions displayed when purchased.
Gift cards cannot normally be exchanged for cash and no cash change will be given.
If an order paid partly by gift card is refunded, the gift-card portion may be returned as gift-card credit.
Nothing in this section removes any mandatory cancellation or consumer rights that apply.
19. Website Use
You may use this website for lawful personal shopping and information purposes.
You must not:
-
Use the website unlawfully or fraudulently.
-
Attempt to interfere with its operation or security.
-
Introduce viruses, malicious code or other harmful material.
-
Copy or exploit website content for commercial purposes without permission.
-
Use automated systems to extract substantial website content without our written consent.
-
Submit false, misleading or abusive information.
We may suspend access where reasonably necessary to protect the website, our customers or our business.
20. Intellectual Property
Unless otherwise stated, the jewellery designs, product names, photographs, written content, graphics, branding and other original material displayed on this website belong to Fate Jewellery or are used with permission.
They are protected by applicable intellectual-property laws.
You may not reproduce, publish, sell, distribute, modify or commercially use our content or designs without prior written permission.
Purchasing a piece of jewellery does not transfer copyright or other intellectual-property rights in its design, photographs or associated content.
21. Reviews and Customer Content
If you submit a review, photograph or other content, it must be truthful, based on your genuine experience and must not infringe another person’s rights.
We will not knowingly publish fake or misleading reviews.
By providing content directly to us for publication, you give us permission to display it in connection with Fate Jewellery. We will ask permission before using customer photographs for wider promotional purposes where appropriate.
We may decline or remove content that is unlawful, abusive, irrelevant, contains personal information or breaches these Terms. We will not suppress a genuine review merely because it is negative.
22. Third-Party Services and Links
Our website may contain links to external websites or use services supplied by Shopify, payment providers, delivery companies, social-media platforms and other third parties.
We are not responsible for the content, availability or privacy practices of independent third-party websites.
Your use of a third-party service may also be governed by that provider’s terms and privacy policy.
23. Events Outside Our Reasonable Control
We are not responsible for delays or failures caused by events outside our reasonable control, such as severe weather, postal disruption, customs delays, industrial action, network failures, fire, flood, epidemic, government action or material-supply disruption.
We will take reasonable steps to minimise the effect and will contact affected customers where appropriate.
This section does not remove any right you may have to cancel where delivery is significantly delayed or where the law otherwise permits cancellation.
24. Our Responsibility to You
We are responsible for foreseeable loss or damage caused by our breach of these Terms or failure to use reasonable care and skill.
We are not responsible for loss that was not reasonably foreseeable when the contract was formed.
Products sold through this website are intended primarily for personal use. We are not responsible for business losses such as lost profit, revenue, opportunity or business interruption where a consumer purchases an item for personal use.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:
-
Death or personal injury caused by negligence.
-
Fraud or fraudulent misrepresentation.
-
Breach of your statutory consumer rights.
-
Any other liability that cannot legally be excluded.
25. Personal Information
We process personal information in accordance with our Privacy Policy and Cookie Policy.
We use order information to process payments, prepare and deliver purchases, provide customer service, prevent fraud and meet legal and accounting obligations.
Please read the Privacy Policy for further information about how personal information is collected, used and protected.
26. Complaints
If you have a concern or complaint, please contact:
Email: hello@fatejewellery.co.uk
Address: [BUSINESS POSTAL ADDRESS]
Telephone: [TELEPHONE NUMBER]
Please include your name, order number and a clear description of the issue.
We will acknowledge and try to resolve complaints fairly and within a reasonable time.
27. Changes to These Terms
We may update these Terms to reflect changes in our business, website, services or applicable law.
The Terms applying to an order will normally be those displayed when the order was placed, unless a change is required by law or expressly agreed with you.
The latest revision date will appear at the top of this page.
28. Severability
If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
29. No Waiver
If we delay enforcing a provision of these Terms, this does not mean we have waived our right to enforce it later.
30. Governing Law and Courts
These Terms and any contract between you and Fate Jewellery are governed by the laws of England and Wales.
If you live in another part of the United Kingdom, you may also bring proceedings in the courts of the part of the UK where you live.
If you live outside the UK, you may have mandatory rights under your local consumer law that these Terms cannot exclude.
